Legal Assessment on the Notification of Payrolls via REM System


Article 23 of the Law No. 7555 on the Protection of the Value of Turkish Currency and Amending Certain Laws and Decree Law No. 635 (“the Law”), published in the Official Gazette dated 24 July 2025 and numbered 32965, introduced an amendment to Article 109 of the Turkish Labour Law. Pursuant to the amendment, notifications other than termination of employment may now be served via the Registered Electronic Mail ("REM") system, provided that the employee’s explicit consent is obtained.

 

In this context, our information note examines the legal implications of delivering payrolls via REM in terms of evidentiary value under Turkish law. In particular, it discusses the necessity of securing the employee’s qualified electronic signature for payrolls to be deemed valid written evidence in court, in light of the relevant legislation and established case law of the Court of Appeal.
