Information Note on the Draft Law on Digital Copyright

A Draft Law on Digital Copyright and Online News Contents (“Draft Law”) has recently been submitted to the Grand National Assembly of Türkiye, aiming to regulate the economic relationship between digital platforms and media organizations in the digital environment.

The Draft Law introduces a new digital copyright payment obligation for large digital platforms that generate economic value through the listing, summarizing, previewing, or directing users to news content. In this context, the Draft Law establishes a sui generis revenue-sharing mechanism to ensure that media organizations receive fair compensation for the use of their content.

In addition, the Draft Law sets forth detailed provisions regarding negotiation and mediation procedures, dispute resolution mechanisms to be established within the Information and Communication Technologies Authority, transparency obligations concerning algorithmic systems, and strengthened administrative sanctions in cases of non-compliance.
