Draft Law on the Efficient and Effective Functioning of the Judiciary
The Draft Law on Amendments to Certain Laws for the Efficient and Effective Functioning of the Judiciary, commonly referred to as the "12th Judicial Package" (“Draft Law”), was submitted to the Presidency of the Grand National Assembly of Türkiye on 22 June 2026 and adopted by the Assembly Justice Commission on 25 June 2026.
The Draft Law proposes significant amendments to various pieces of legislation, primarily the Civil Procedure Law, the Administrative Procedure Law, the Enforcement and Bankruptcy Law, the Turkish Code of Obligations, and the Criminal Procedure Law. The proposed amendments focus on enhancing the efficiency of judicial proceedings, ensuring that proceedings are concluded within a reasonable time, restructuring the system of legal remedies, supporting digitalization, and addressing practical uncertainties.
Among the notable proposals are the abolition of the action for an indeterminate claim, restrictions on remand decisions by Regional Administrative Courts, revisions to the statutory interest regime, amendments concerning dissolution of partnership proceedings, digital transmission of notarial documents, and changes to various criminal procedure mechanisms.
