Note on the Intellectual Property Rights Issue in Artificial Intelligence Products
In this article, recommendations have been provided for the legal nature of intellectual products created by artificial intelligence under the current provisions of Intellectual and Artistic Works Law numbered 5846. The article addresses issues such as the legal nature of intellectual products generated by artificial intelligence, ownership rights over these products, and various alternatives related to authorship, including creator, owner, user, artificial intelligence itself, or public ownership in products created using artificial intelligence.
Although there is no established precedent in Turkey regarding the intersection of artificial intelligence and copyright, this issue has become a frequently debated topic in the doctrine, similar to international platforms. Therefore, various opinions have been discussed, such as granting artificial intelligence a separate legal personality, recognizing electronic personality, attributing rights/responsibilities arising from works created by artificial intelligence to the owner and programmer of the artificial intelligence, or attributing the product created by artificial intelligence to the public.
