Announcement in the form of notice published on the Official Website of RTUK


In accordance with Article 47/2 of the Law on the Establishment of Radio and Television Enterprises and Their Media Services numbered 6112 (the “Law numbered 6112”), the Radio and Television Supreme Council ("RTUK") published an announcement on July 03, 2024, as a legal notification to all media service providers regarding the regulation of retransmission.

 

With the provisional Article 4/1 of the Law numbered 6112, which states "During the period until the terrestrial broadcast licenses are issued by the Supreme Council through a ranking auction, only radio and television organizations broadcasting terrestrially under the provisional Article 6 of the Law numbered 3984 on the Establishment of Radio and Television Enterprises and their Broadcasts may continue their broadcasts limited to the settlements permitted by the Supreme Council." it is emphasized that during the period until the ranking auction is conducted and terrestrial broadcast licenses are issued by RTUK, radio and television organizations broadcasting terrestrially cannot broadcast in locations other than those determined by RTUK.

 

Furthermore, in the same announcement, elements related to the retransmission institution were reviewed, and with RTUK's decision no. 5 taken at its meeting dated May 09, 2024 and numbered 2024/21, the following decisions were made to ensure uniformity in retransmission activities:

 

-      At the beginning of each radio broadcast/program to be retransmitted, the source organization of the broadcasts and the name of the program must be indicated, and an announcement "This is a retransmission" must be made. In television broadcasting services, the logos of both the source organization and the retransmitting organization must be displayed on the screen simultaneously throughout the retransmission broadcasts.

-      If a violation of the provisions specified in the first article is detected, sanctions will be applied to the media service provider organization retransmitting the broadcasts under Article 32/2 of Law numbered 6112.

-      The decision of the Supreme Council will be published in the Announcements in the form of Notice with Notification Nature section on the RTUK website.

-      Matters and transactions related to improperly conducted retransmission activities will be handled by the Monitoring and Evaluation Department.

In this context, it was emphasized that media service provider organizations must arrange their retransmission contracts and practices in accordance with the above-mentioned matters and relevant provisions of RTUK regulations. Otherwise, sanctions will be applied to these media service provider organizations under Article 32/2 of Law numbered 6112.
